Terms and Conditions of Stay at the Forest Apartment
We want to avoid misunderstandings and ensure a successful, comfortable and safe holiday for our Clients/Guests. Please read these Terms and Conditions of Stay. They are an integral part of the rental (booking) agreement. Each Client/Guest who makes a booking simultaneously accepts these terms and conditions.
- The apartment is rented by the day as part of the provided accommodation service.
- A day’s stay in the apartment lasts from 3:00 pm (on the day of arrival) to 10:00 am (on the day of departure).
- The minimum stay in the apartment is 4 nights.
- Booking of the stay is made by the Client (Guest) via our website.
- Upon booking, the Client (Guest) is obliged to pay the BOOKING FEE (30% of the amount for rental) towards the main service within 3 days by wire transfer or through the booking system on our website.
- BOOKING FEE – a fee paid by the Client (Guest), equivalent to 30% of the amount for rental, representing a security for the costs of preparing the apartment, which is refundable only in the event of cancellation of booking 30 days before the planned start of the stay.
- Cancellation of the stay requires a written declaration in the form of an email to the following email address: recepcja@forestapartment.pl
- In case of failure to pay the deposit, the booking of the stay may be cancelled.
- The outstanding amount due for the stay in the apartment is to be paid by the Client (Guest) not later than 72 h before arrival (date of rental) by wire transfer. We do not accept cash payments.
- Local tax is added during booking.
- Payment for the stay (unused rental period) is non-refundable if the Client (Guest) shortens the stay.
- The Client will not be entitled to withdraw from the preparation of the apartment and thus the right to a refund of the booking fee.
- Rescheduling is possible when the date chosen by the Client (Guest) is available. Such change is not subject to an additional fee. Booking changes can be made up to 30 days before the planned arrival.
- It is possible to extend the stay in the apartment if the required date is available. Additional costs (rental fees) will be charged.
- With the consent of the Accommodation Provider, the Client (Guest) may transfer all rights and obligations under the agreement to a third party, provided that such third party assumes all such rights and obligations under the agreement.
- A change of booking by the Accommodation Provider is only possible in the event of force majeure that prevents service performance. Force majeure is to be understood as: natural disasters, the seizure of the apartment by any state authority for any purpose, strikes, wars and riots and the failure to provide electricity, gas, heating energy or water by the supplier. The Accommodation Provider will then be obliged to offer the Client an alternative date or to withdraw from the agreement and return the booking deposit paid by the Client (cancellation of booking).
- The Accommodation Provider reserves the right to cancel a booking without giving a reason within 24 hours after it is made. In the event of cancellation, the Client (Guest) will receive a refund of all funds paid.
- Smoking tobacco products, other stimulants, e-cigarettes and the use of open flames are strictly forbidden in the apartment. This prohibition applies throughout the building in which the apartment is located, in the common parts of the building (stairwells, lift, balcony, swimming pool, etc.), as well as in neighbouring premises. Smoking is possible in areas designated by the Building/Facility Administrator.
- Failure to comply with this prohibition (preceding paragraph) is tantamount to the Client agreeing to pay the cost of removing the smell from the premises in the amount of PLN 500.
- Animals are not accepted in the apartment. Failure to comply with this prohibition will result in charging the Client with a fine of PLN 100 for each day booked by the Client.
- The facility/apartment must be kept quiet between 10 pm and 7 am.
- The behaviour of the Guest/Client and persons using the services of the apartment should not disturb the peaceful stay of other guests/clients in the facility. The Accommodation Provider may refuse to provide further services to the Client who violates this rule and will not be then obliged to refund the unused period of stay.
- Check-in is carried out using an electronic lock.
- The apartment staff/Accommodation Provider will send the Client the code for opening the apartment door and the code for opening the main door of the facility to the telephone number or email address provided in the booking form up to 24 hours before arrival. The code is valid for the entire stay of the Client (Guest) in the apartment. After the end of the stay, the code becomes invalid.
- In the event that the system fails or the Client (Guest) does not receive the code by the time of arrival, it is necessary to contact the apartment staff by telephone (+48 530 530 325).
- The apartment is released to the Client for use upon payment by the Client (Guest) of the total rental price, i.e. the amount constituting the difference between the rental price and the booking deposit paid, which is credited towards the rental price.
- On the day of check-in, the Client should report any reservations or defects found in the apartment.
- Failure to report any comments or reservations (at least in documentary form: text message, email, etc.) regarding the technical condition on the day of check-in at the apartment is tantamount to assuming that the apartment, as well as the equipment contained therein, is in a condition that does not raise any comments or reservations by the Client (Guest).
- In the event of any damage, the Client (Guest) is obliged to notify the apartment staff (+48 530 530 325) of such damage immediately upon its discovery, which will facilitate its prompt repair or prevent it from aggravating its negative consequences.
- The Client (Guest) is fully responsible for any damage to the apartment or its equipment and common property, including common parts of the building in which the apartment is located, as well as neighbouring apartments, not resulting from normal use, caused by the Client or persons to whom the Client has made the apartment available for use or stay in any way.
- The Client is obliged to observe the principles of good neighbourliness, to maintain cleanliness in the apartment, in the stairwells and within the building, and to keep the rented apartment in good condition.
- In the event of a stay of a person not reported in the booking form, the Accommodation Provider has the right to charge a penalty of PLN 300 per day for each person not reported and has the right to terminate the agreement with immediate effect and remove the Clients (Guests) and their accompanying persons from the apartment.
- Due to fire protection requirements, in the apartment it is forbidden to use any devices or appliances powered by electricity or gas which do not belong to the equipment of the apartment and which may create a fire hazard, e.g. coil heaters, heaters, gas burners. It is forbidden to bring flammable materials, explosives or materials with an unpleasant smell into the apartment.
- When leaving the apartment, please check that it is locked. Please take care of the rented apartment, turn off unnecessary lighting and turn off the water. It is forbidden to interfere with the equipment, layout, furniture arrangement and security features of the apartment, and to tamper with the electronics.
- Persons under the age of 18 should be on the premises and in the apartment under the constant supervision of their guardians who bear financial and legal responsibility for any damage caused by the actions of minors. The guardians/Clients are responsible for the safety of minors in accordance with applicable legislation.
- The Accommodation Provider is not responsible for the belongings of the Client (Guests) and/or persons using the apartment that have been left in the apartment and the car park respectively, both during the term of the rental agreement and after its expiry.
- The Accommodation Provider is not liable for any loss or theft of items belonging to the Client (Guest) and left in the apartment: money, securities, valuables and other valuable items (e.g. items of scientific and artistic value).
- The Accommodation Provider is not liable for damage to the vehicle belonging to the Client (Guest) or valuables left therein.
- The Clients/Guests undertake to use the apartment for residential purposes only, for relaxation – it is forbidden to organise social events in the apartment/facility.
- In the event that the Client/Guest grossly violates the peace and/or welfare of neighbours and does not respect the generally accepted norms of coexistence between people, the Accommodation Provider reserves the right to terminate the Client/Guest’s stay and will not be then obliged to refund the unused period of stay.
- The Accommodation Provider reserves the right, in the event of sudden defects or other fortuitous events, to shorten the booking and refund the unused nights.
- In the event of losing the keys (if any) to the apartment/facility, the Client (Guest) will pay the cost of PLN 500.
- In the event of losing the key fob to the swimming pool, the Client (Guest) will bear the cost of its replacement in the amount of PLN 100.
- The provisions of the Polish Civil Code apply to matters not covered by these Terms and Conditions.
- In the event of any differences between the interpretation of the Polish and English versions hereof, the Polish version will prevail.
